29 CFR 1918.22(e):The employer did not provide a net or other suitable protection where the gangway overhung the water so that there was danger of employees falling between the ship and the dock. 10 Ave. Marine Terminal, Birth 10-3, Dole Caribbean docked: On or before May 26, 2021 the employer did not ensure the ship railing safety net was in a serviceable condition. The railing safety net had multiple holes one measuring 29 inches in length. Employee(s) were exposed to head and limb injuries from falling, and/or drowning hazards.

29 CFR 1918.97(e)(1):The employer did not ensure that there was in the vicinity of each vessel being worked, at least one U.S. Coast Guard approved 30-inch life-ring with no less than 90 feet of line attached, and at least one portable or permanent ladder that reaches from the top of the apron to the surface of the water. 10 Ave. Marine Terminal, Birth 10-3, Dole Caribbean docked: On or before May 26, 2021 the employer did not ensure the total length of the U.S. Coast Guard 30 -inch life-ring attached line was no less than 90 feet. The line was measured at 88 feet from the point of attachment. Employee(s) were exposed to hypothermia and/or drowning hazards.
