29 CFR  1926.651(k)(1):An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift.  Jobsite - The employee designated by the employer as the competent person did not recognize the hazards associated with under mining, having the idling excavator located right over top of the area that was under mined, and an inadequate protective system in place prior to entering the excavation.

29 CFR  1926.652(c)(4)(1):Support systems, shield systems and other protective systems not utilizing design options described in 29 CFR 1926.652 (b) or (c) were not approved by a registered professional engineer.  Jobsite - The employee was not protected by an adequate protective system approved by a registered professional engineer. The employee was protected on two sides by sheet pilings, but there was no protection on the backside of the work area, where the cave-in occurred.
