29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:   (a) Brock Services LLC, 2101 S. Ranney Street, Craig Colorado 81625: On and before May 11, 2021, the employer did not provide medical evaluations to determine the employees ability to use a respirator, before the employee employees were required to use the respirator in the workplace. Employees were required to wear half-face elastomeric respirators while installing scaffolding inside the C-11 Coal Chute. This condition exposed employees to a respiratory  hazard.  Note: The requirements applicable to construction work under 1926.103 are identical to those set forth in 1910.134.

29 CFR  1910.134(f)(2):  Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator:  (a) Brock Services LLC., 2101 S. Ranney Street, Craig , CO 81265: On and before May 11, 2021, the employer did not ensure that employees assigned to use tight fitting elastomeric respirators received a fit test prior to wearing the respirators.  Employees were required to wear half-face elastomeric respirators while installing scaffolding inside the C-11 Coal Chute. This condition exposed employees to a respiratory  hazard.  Note: The requirements applicable to construction work under 1926.103 are identical to those set forth in 1910.134.

29 CFR  1926.1204(c): The employer did not implement the means, procedures, and practices necessary for the safe entry operations, including but not limited to specifying acceptable entry conditions; providing each authorized entrant or that employee's authorized representative with the opportunity to observe any monitoring or testing of permit spaces; isolating the permit space and physical hazards within the space; purging, inerting, flushing, or ventilating the permit space as necessary to eliminate or control atmospheric hazards; determining that, in the event the ventilation system stops working, the monitoring procedure will detect an increase in atmospheric hazard levels in sufficient time for the entrants to safely exit the the permit space:   (a) Brock Services, LLC, at 2101 South Ranney Street in Craig, CO 81625: On or before May 11, 2021, the employer did not implement the means, procedures, and practices necessary for safe permit space entry operations and verify that conditions in the permit space were acceptable for entry throughout the duration of an authorized entry. Employees worked in a permit space to install scaffolding on the fifth floor of the C-11 Coal Chute in the Coal Transfer Building, and the employer did not ensure confined space hazards, such as falls, moving equipment, falling objects, and coal dust,  were controlled before employees entered the space.

29 CFR  1926.1206(h): The entry permit that documented compliance with this section and authorized entry to a permit space did not identify the hazards of the permit space to be entered:  (a) Brock Services, LLC, at 2101 South Ranney Street in Craig, CO 81625: On or before May 11, 2021, the employer did not ensure the entry permit that documented compliance with this section and authorized entry to a permit space identified the hazards of the permit space to be entered. Employees worked in a permit space to install scaffolding on the fifth floor of the C-11 Coal Chute in the Coal Transfer Building with hazards including falls, coal dust (respirable irritant and hazard; eye irritant), dropped objects, low visibility, and moving equipment . The permit did not document the coal dust hazards, fall hazards, or moving equipment hazards.  This exposed employees to confined space hazards.
