29 CFR  1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Located at Lot 27, 6769 Oliver Way, Dublin, Ohio: On or about May 27, 2021, and at times prior, the employer failed to maintain an effective safety and health program to ensure that hazards were identified and corrected onsite while employees performed framing work, thereby exposing employees to falls from height and struck-by hazards.

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  Located at Lot 27, 6769 Oliver Way, Dublin, Ohio:  a. On or about May 27, 2021, employees were not utilizing eye protection while installing sheathing on the roof trusses of a residential structure being built with a pneumatic nail gun. As a result, employees were exposed to struck-by hazards associated with flying wood particles and nails.  b. On or about May 27, 2021, an employees was not utilizing eye protection while installing sheathing on the exterior of the residential structure being built with a pneumatic nail gun. As a result, the employee was exposed to struck-by hazards associated with flying wood particles and nails.  c. On or about May 27, 2021, an employees was not utilizing eye protection while using a portable circular saw to cut sheathing for the exterior of the residential structure. As a result, the employee was exposed to struck-by hazards associated with flying wood particles.

29 CFR  1926.501(b)(13):  "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Located at Lot 27, 6769 Oliver Way, Dublin, Ohio:  a. On or about May 27, 2021, employees were working from the trusses and roof of the residential structure being built to install sheathing without the use of fall protection measures. As a result, employees were exposed to fall hazards of up to approximately 17 feet.   b. On or about May 27, 2021, an employee was working from an unprotected edge of the trusses on the exterior right side of the residential structure being built to install sheathing without the use of fall protection measures. As a result, the employee was exposed to a fall hazard of up to approximately 9 feet.  c. On or about May 27, 2021, employees were gathering wooden materials through unprotected window openings on the second story of the residential structure being built without the use of fall protection measures. As a result, the employees were exposed to a fall hazard of approximately 12 feet.  Fabulous Roofing, LLC. (Fabulous Roofing & Home Improvement LLC) was previously cited for a Repeat Serious violation of this Occupational Safety and Health Standard, which was contained in OSHA inspection number 1237552, citation number 1, item number 1, and was affirmed as a final order on August 15, 2017, with respect to a workplace located at Building #22 at the Village at Olentangy Crossing in Lewis Center, Ohio.
