29 CFR 1926.452(j)(3): When guardrails were used for fall protections, a workbench meeting the requirements was in use as the toprail only. The midrail was miss: A. On or about 05/27/21, on the ground of 37-48/50 95th Street. Corona, NY Employees installing siding on the exterior wall were exposed to the hazard of falling approximately 20 feet to the neighboring flat roof. The midrail of the pump jack scaffold was missing. ABATEMENT VERIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access: A. On or about 05/27/21, on the ground of 37-48/50 95th Street. Corona, NY Employees were using a portable ladder to gain access to a roof. The ladder side rails extended less than two foot above the upper landing surface. ABATEMENT VERIFICATION IS NOT REQUIRED PURSUANT TO 29 CFR 1903.19.
