29 CFR 1926.760(a)(1):Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems. On or about May 25, 2021, during the installation of structural steel at a new commercial construction site located at 12301 Cedar Rd, Cleveland Heights, Ohio 44106; the employer did not ensure employees were protected from fall hazards of approximately 15.5 feet above the ground by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems. The employee was engaged in relocating an installed steel beam/post on the exterior part of a second floor deck on the south side of the structure.
