29 CFR 1926.451(a)(6):Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design.  On or about May 28, 2021, and at times prior thereto, two workers were unloading windows from a job-made wooden trash box supported by the forks of a Rough Terrain Truck that was not designed to support personnel. The trash box was elevated up to approximately 33 feet on the apartment building under construction, exposing the workers to a fall hazard.

Note: The requirements applicable to construction work under this paragraph are identical to those set forth at 1910.178(l) of this chapter.  29 CFR 1910.178(l)(1)(ii) Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).  On or about May 28, 2021, and at times prior thereto, the employer did not ensure that the operators of the Rough Terrain Truck were trained in the safe operations of the forklift, exposing workers to hazards such as, but not limited to being struck by moving objects, struck by falling loads and crushed by forklift tipping.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.   On or about May 28, 2021, two workers were unloading windows from a job-made, wooden trash box up to approximately 11 feet high at the apartment complex under construction without the use of fall protection, exposing workers to a fall hazard.
