29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):  (a) Markel Homes Construction Company at 1312 Snowberry Lane in Louisville, CO 80027: On or before 5/25/2021, the employer did not maintain a safety program which provided for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them). Employees of Steele Bros. Heating Inc., subcontractor, were directed to install HVAC systems on 3-story apartment building with an open elevator shaft that was not guarded and was not covered. The employer did not inspect the work areas to determine the presence of floor openings or other fall hazards prior to initiation of work. This condition exposed employees to a fall hazard of approximately 35 feet which resulted in a broken ankle of one subcontractor employee.
