OSH ACT of 1970 Section (5)(a)(1) Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of contracting the virus, SARS-CoV-2 (severe acute respiratory syndrome coronavirus 2), the cause of the COVID-19 disease. 29 CFR 1915.12(d)(1):The employer shall ensure that each employee that enters a confined or enclosed space and other areas with dangerous atmospheres is trained to perform all required duties safely. a) On or about March 4, 2021, while working at the Fincantieri Bay Shipbuilding shipyard at 605 North 3rd Avenue, Sturgeon Bay, Wisconsin, an employee entered confined and enclosed spaces of the James R. Barker vessel to perform weld testing and was not trained on the procedure to request ventilation installation for confined/enclosed spaces at Fincantieri Bay Shipbuilding, the prohibition of performing work that creates sparks within in a confined/enclosed space that had not been certified for "Hot" work, and other safety rules and policies associated with working within Maritime confined and enclosed spaces.
