29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: (a) On or about June 2, 2021, an employee engaged in roofing a new residential property and utilized a ladder to access the roof that did not extend at least three (3) feet above the landing. This exposed employees to a fall hazard of approximately 12 feet.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about June 2, 2021, an employee engaged in roofing a new residential property, on an 8/12 pitched roof, was not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 12 feet. Bauer Exteriors was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1424175, citation number 1, item number 2 and was affirmed as a final order on September 16, 2019, with respect to a workplace located at 35234 Walleye Drive, Oconomowoc, WI 53066.
