29 CFR 1910.141(g)(4): The employer allows food and beverages to be stored in an area where the food and beverages are exposed to a toxic material. On or about June 4, 2021, the employer at Magic Tunnel Express Car Wash at 8715 Ohio Route 66 in Defiance, Ohio 43512 had a cabinet inside of the working area where employees can store food and drinks and exposed them to the hazard of ingestion of corrosive and toxic chemicals. The working area has employees spray and use products that contain Ethanolamine and Dodecylbenzenesulfonic acid to wash cars entering the car wash tunnel.

29 CFR 1910.147(c)(1): The employer failed to establish a program consisting of energy control procedures and periodic inspections and employee training to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. On or about June 4, 2021, the employer at Magic Tunnel Express Car Wash at 8715 Ohio Route 66 in Defiance, Ohio 43512 did not develop an effective energy control program to train and protect employees by isolating the energy sources within the car wash tunnel for daily cleaning operations where employees have to get within inches of moving wraps using hydraulic energy that use a pressure of 50 psi to clean cars inside of the car wash.
