29 CFR  1910.1200(e)(1):Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):   On or about June 8, 2021, the employer did not implement or maintain a hazard communications program containing the criteria contained in paragraphs (f), (g) and (h), exposing the employee to the hazards associated with Silica and Portland cement.  Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR  1926.453(b)(2)(iv):Employee(s) working in an aerial lift were sitting or climbing on the edge of the basket:  On or about June 8, 2021 an employee was sitting on the top guardrail of the aerial lift he was working from, exposing the employee to a fall of approximately 17 feet.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.453(b)(2)(v):A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:  On or about June 8, 2021 employees were not protected from a fall while working from an aerial lift, exposing employees to a fall of approximately 17 feet.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
