OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.  The employer is failing to protect employees from struck-by hazards. Employees are exposed to the hazard of being struck by falling material and equipment.  This most recently occurred on June 8, 2021, at 300 North Black Cat Road, Joplin, Missouri, when an employee worked from a trailer underneath the hook and headache ball attached to the crane auxiliary line, and was struck by the falling hook, headache ball, and wedge socket assembly.  Among other methods, one feasible and acceptable abatement method is to:  a) Ensure the anti-two-block device is frequently tested and operational per the manufacturer's operator manual Pg. 29.  b) Make sure the operator is aware of how the anti two-block device works and what happens if the weight comes into contact with the crane boom tip.  c) Ensure that the wedge socket is properly installed.  Rotation Resistant Wire Rope was being used and the minimum tail length is 20 rope diameters per the manufacturer's operator manual section Wire Rope Technical Board- Wire Rope Users Manual Fourth Edition Pg. 43.  d) Obtain a manufacturer's operator and service manual to follow usage and maintenance guidelines.

29 CFR  1910.135(a)(1):The employer shall ensure that each affected employee wears a protective helmet when working in areas where there is a potential for injury to the head from falling objects.  The employer is failing to protect employees from overhead struck by hazards. This was most recently documented on or about June 8, 2021 at U. S Assets, located at 300 North Black Cat Road, Joplin, Missouri. Employees in the vicinity of the Lorain mobile crane were lifting vessels into a tank and were not wearing hard hats.

This was most recently documented on or about June 17, 2021, at Gator Industries, LLC located at 300 North Black Cat Road, Joplin, Missouri.  Employees had operated the forklift longer than three years without an evaluation of the operator's performance.

The employer did not have the Lorain MCH 250D mobile crane inspected prior to initial use.

29 CFR  1910.180(g)(2)(ii): All rope which has been idle for a period of a month or more due to shutdown or storage of a crane on which it is installed shall be given a thorough inspection before it is used. This inspection shall be for all types of deterioration and shall be performed by an appointed or authorized person whose approval shall be required for further use of the rope. A certification record which includes the date of inspection, the signature of the person who performed the inspection, and an identifier for the rope which was inspected shall be prepared and kept readily available.   The employer is failing to protect employees from struck by hazards.  This was most recently documented on or about June 17, 2021, at Gator Industries, LLC located at 300 North Black Cat Road, Joplin, Missouri.  All rope which had been idle for a period of a month or more due to shutdown or storage of a crane was not given a thorough inspection before it was used.   The Lorain MCH 250D 25 ton truck mounted crane had been idle greater than a month.  There was no written record including the date of inspection, the signature of the person who performed the inspection, and an identifier for the rope which was inspected.
