29 CFR 1910.178(l)(4)(ii)(B): Refresher training in relevant topics shall be provided to the operator when the operator has been involved in an accident or near-miss incident. On or about April 30, 2021, an employee operating a Toyota Model 8HBW23 Electric Truck was involved in an accident and did not receive retraining prior to being allowed to resume operating the lift.

29 CFR 1910.178(l)(6):Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation. On or about June 10, 2021, the employer had not developed and maintained a certification for each employee authorized to operate the motorized hand trucks used to move totes and other materials throughout the facility.
