OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of contracting the virus, SARS-CoV-2 (severe acute respiratory syndrome coronavirus 2), the cause of the COVID-19 disease: a) On or about May 5, 2021, in the Lab, employees worked in close proximity with employees exposed to COVID-19 without facemasks or the cleaning of high touch areas including, but not limited to lab surfaces and shared company vehicles.
