29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: (a) In the warehouse, on or about June 09, 2021, and times prior to, employees were required to operate a forklift in the performance of their duties. The employer removed the seat belt from the forklift without the manufacturer's prior written approval, which affected the safe operation of the forklift, thus exposing employees to struck-by hazards.

The employer failed to ensure the forklift was removed from services for safety deficiencies, such as a missing seatbelt, thus exposing employees to struck-by hazards.
