This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1926.1153(i)(1): The employer did not include respirable crystalline silica in the program established to comply with the hazard communication standard (HCS) (29 CFR 1910.1200), and did not ensure that each employee has access to labels on containers of crystalline silica and safety data sheets, and is trained in accordance with the provisions of HCS and paragraph (i)(2) of this section to ensure that hazards associated with cancer, lung effects, immune system effects, and kidney effects are addressed:   a) Nine Ships Company dba M-E Construction, 150 West 10th Street in Erie, Pennsylvania. - On or about June 9, 2021, and at times prior thereto: Employees worked with and/or were potentially exposed to crystalline silica while conducting operations including, but not limited to, installing drywall and sanding joint compound. Silica was not included in the employer's hazard communication program,  b) Nine Ships Company dba M-E Construction, 150 West 10th Street in Erie, Pennsylvania. - On or about June 9, 2021, and at times prior thereto: Employees worked with and/or were potentially exposed to crystalline silica while conducting operations including, but not limited to, installing drywall and sanding joint compound.  Safety Data Sheets for silica containing substances including, but not limited to, USG Midwt Joint Compound, and USG Drywall, were not available at the worksite nor was there a method in place for employees to access SDSs.  c) Nine Ships Company dba M-E Construction, 150 West 10th Street in Erie, Pennsylvania. - On or about June 9, 2021, and at times prior thereto: Employees worked with and/or were potentially exposed to crystalline silica while conducting operations including, but not limited to, installing drywall and sanding joint compound.
