29 CFR  1926.451(b)(1)(i):Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights was no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary (for example, to fit around uprights when side brackets are used to extend the width of the platform):  On or about February 23, 2021, employees were exposed to a fall hazard while preparing to apply stucco to a building with the scaffold platform having planks being greater than 1 inch apart.

29 CFR  1926.451(e)(1):  When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used:  On or about February 23, 2021, employees were exposed to a fall hazard while working from a scaffold without a ladder or similar structure for access attached.

Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews:   On or about February 23, 2021, employees were exposed to a fall hazard while preparing to apply stucco to a building without the scaffold platform having a complete guardrail system installed.

29 CFR  1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.   On or about February 23, 2021, employees were exposed to a fall hazard greater than 6 feet from the ground below while preparing to apply stucco, without using any form of fall protection.
