29 CFR  1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  (a) On or about June 16, 2021, the employer did not develop and implement a control of hazardous energy (lock-out/tag-out) program that included employee training, procedures for controlling hazardous energy on machinery that is being serviced/maintained/repaired, and periodic inspections of procedures and employee performance of procedures. This exposed employees to caught in, crushing and amputation hazards.

29 CFR  1910.147(e)(1): Before lockout tagout devices were removed, the work area was not inspected to ensure that nonessential items had been removed or ensured that machine or equipment components were operationally intact.  (a) On or about June 10, 2021, an employee was exposed to amputation/entanglement hazards from the chain and sprocket on a movable conveyor, when the guard was not re-installed after servicing .  In the alternative...  29 CFR  1910.219(f)(3): Sprocket wheels and chains which were seven (7) feet or less above floors or platforms were not enclosed:  (a) On or about June 10, 2021, an employee was exposed to amputation/entanglement hazards from an unguarded chain and sprocket on a movable conveyor .

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) On or about June 16, 2021, at this location, employees engaged in food packaging were exposed to hazardous materials, such as but not limited to, food grade cleaning chemicals and lubricants. The employer had not developed and implemented a program which would address labeling and other forms of warnings on hazardous material containers, Safety Data Sheets, and employee information and training on the hazards associated with the hazardous materials utilized on site.  The written program must also contain the following: 1. A list of all hazardous materials on site; 2. The methods the employer will use to inform employees of the hazards associated with non-routine tasks involving hazardous materials, such as spills; 3. The hazards of the materials contained in piping that is not labeled, and; 4. The method the employer will use to inform other employers (contractors) of the chemicals their employees might be exposed to while performing duties at the site.
