29 CFR 1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. a) Olam Construction LLC, at a jobsite located at 50 Coughlin Lane, Delaware, Ohio 43015: On and/or preceding June 14, 2021, the employer failed to maintain a safety and health program such as but not limited to a fall protection program to ensure detection and correction of hazards during construction activities.

29 CFR 1926.453(b)(2)(v):A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). a) Olam Construction LLC, at a jobsite located at 50 Coughlin Lane, Delaware, Ohio 43015: On and/or preceding June 14, 2021, the employer failed to ensure employees were protected from falls while working from an elevated platform of an aerial lift. An employee did not have his fall protection lanyard connected while installing metal roofing on the roof dormers of a building, thereby exposed to an 18 foot fall hazard.
