OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not provided with a means to perform an emergency stop of the Rib line conveyor at the in going nip point. The nearest available emergency stop was located approximately twenty-five (25) feet from in going nip point of rib line conveyor. (a) Rib Line; On or about May 20, 2021 and at times prior to, the employer exposed operators to amputation hazards from in-going nip point of the Rib line conveyor in that emergency stops (E-Stops) were not installed or readily accessible at the in-going nip point of the conveyor system, employees would have to travel in excess of twenty-five (25) feet to reach the hydraulic power valve in case of emergency.

29 CFR 1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, and rotating parts: Rib Line, FPL Food LLC plant, Augusta Georgia: On or about May 20, 2021 and at times prior to, the employer exposed Rib Line operators to amputation hazards, in that the line conveyor system was not guarded to protect workers from in-going nip points.
