29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction, LOT 978, Second floor: On or about 6/17/2021, and at times prior, the employer exposed employees to fall hazards, in that a complete fall protection system was not provided to employees who were conducting framing activities on the second floor with unprotected edges at heights measured at 13 feet 5 1/2 inches to the lower level. Employees were conducting framing activities on the second floor. b) New residential construction, LOT 978, Top plate: On or about 6/17/2021, and at times prior, the employer exposed employees to fall hazards, in that a complete fall protection system was not provided to employees who were walking on the top plate conducting framing activities at heights measured at 21 feet 10 inches to the lower level. Employees were conducting measurements for framing activities while walking on the top plate. c) New residential construction, LOT 978, Second floor: On or about 6/17/2021, and at times prior, the employer exposed employees to fall hazards, in that a complete fall protection system was not provided to employees who were conducting framing activities on the second floor with open window frames at heights measured at 9 feet 11 3/4 inches to the lower level. Employees were conducting framing activities on the second floor in close proximity to window frames that did not have any guardrails for employee fall protection.
