29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to struck by hazards from on going road traffic. a) 1 Barker Road, Gloversville, NY-On or about June 17, 2021, Employees were exposed to struck by hazards when transferring/transporting/loading tree debris into the loading vehicles on an active roadway without adequate safeguards. Employees performed tree removal operations and other operations to facilitate the removal of trees near an active city street without the use of a properly communicated traffic control plan and internal traffic control plan.

Employees did not wear leg protection such as protective chaps while trimming branches. b) 1 Barker Road, Gloversville, NY-On or about June 17, 2021, employees were exposed to hearing hazards while operating chainsaws and wood chippers during tree removal. Employees did not utilize hearing protection while quartering logs and trimming branches.
