29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from crushed by hazards by not having operator restraint devices installed on powered industrial equipment: a. 4050 Tremley Point Rd., Linden, NJ - Warehouse The employer did not ensure that employees operating powered industrial equipment used in the movement of materials within the warehouse used operator restraint devices. Employees engaged in warehousing activities operated forklifts that included, but were not limited to, Yale, model GLP030VX forklifts, and did not use seatbelts which were intended to assist the operator in reducing the risk of entrapment of the operator's head and/or torso between the truck and ground in the event of a tip over. Violation observed on or about June 22, 2021
