29 CFR  OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from crushed by hazards by not having operator restraint devices installed on powered industrial equipment:  a. 4050 Tremley Point Rd., Linden, NJ - Warehouse  The employer did not ensure that employees operating powered industrial equipment used in the movement of materials within the warehouse used operator restraint devices.  Employees engaged in warehousing activities operated forklifts that included, but were not limited to, Yale, model GLP030VX forklifts, and did not use seatbelts which were  intended to assist the operator in reducing the risk of entrapment of the operator's head and/or torso between the truck and ground in the event of a tip over.  Violation observed on or about June 22, 2021

29 CFR  1910.178(k)(1):The brakes of highway truck(s) were not set and wheel chocks placed under the rear wheels to prevent truck(s) from rolling:  a. 4050 Tremley Point Rd., Linden, NJ - Warehouse docks  The employer did not ensure that wheel chocks were used at loading docks to prevent highway trucks from rolling.  Employees engaged in warehousing activities loaded trailers and box trucks and pushed pallets of products into the box truck where there were not chocks at the rear wheels to prevent the truck from rolling away while being loaded.  Violation occurred on or about June 18, 2021

29 CFR  1910.178(l)(4)(ii)(B):Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been involved in an accident or near-miss incident:  a. 4050 Tremley Point Rd., Linden, NJ - Warehouse  The employer did not provide refresher training for employees involved in an accident.  An employee involved in a forklift accident returned to work and was operating equipment that included, but was not limited to Yale, model GLP030VX, and was not provided refresher training which included an evaluation of effectiveness of training prior to allowing the employee to operate the equipment. Employees engaged in warehousing activities operated equipment that included, but was not limited to Yale, model GLP030VX, forklifts where employees were observed backing out of trailers and moving merchandise in the warehouse while traveling in reverse, and the employee was not looking in the direction of travel.
