29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:   a) 1340 - 1rst Street, Lakewood NJ: On or about and prior to June 16, 2021 the company did not instruct employees in the recognition and avoidance of unsafe conditions regarding what deficiencies constituted placing a company vehicle out of service, not bypassing or removing safety switches, and how to control or eliminate the existence of struck by and caught in hazards when working inside a company vehicle's cement bin/hopper.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

1926.300(b)(3): Machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.    a) 1340 - 1rst Street, Lakewood NJ: On or about June 16, 2021, and at times prior, an employee was exposed to caught in and struck by hazards when operating a company vehicle's cement bin/hopper with it's guard raised and safety interlock switch bypassed.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS  ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.702(j)(1): Employees were permitted to perform maintenance or repair activity on equipment (such as compressors, mixers, screens, or pumps used for concrete and masonry construction activities) where the inadvertent operation of the equipment could occur and cause injury without all potentially hazardous energy sources being locked out and tagged:     a) 1340 - 1rst Street, Lakewood NJ: On or about June 16, 2021, the Putzmeister concrete pump machine was not locked and tagged out with a "Do Not Start" tag while the worker was standing in the concrete hopper with the hopper grate open, the truck's engine running, and a safety interlock switch (that prevented accidental startup of the paddles within the hopper while the hopper's grate was open) being bypassed.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
