29 CFR 1910.212(a)(1):Machine guarding was not provided to protect operator(s) and other employees from hazard(s) created by machines: (a) Asbury Co Sub, LLC dba Mike Shaw Subaru at 1650 West 104th Avenue in Denver, Colorado: On or before June 23, 2021, the employer did not ensure employees were protected from amputation hazards caused by mounting and demounting tires on the Hunter TCX57 tire changer. Use of the equipment created a pinch point, and the employer did not take measures to ensure employees' hands and fingers did not make contact with the nip point. This resulted in an employee suffering an amputation of the left index finger tip.

29 CFR 1910.132(d)(2): The employer did not verify, through a written certification, that the required workplace hazard assessment had been performed: (a) Asbury Co Sub, LLC dba Mike Shaw Subaru at 1650 West 104th Avenue in Denver, Colorado: On or before June 23, 2021, the employer did not verify that the required workplace hazard assessment had been performed through a written certification. The employer did not determine if hazards were present, or were likely to be present, which necessitated the use of PPE, such as impact hazards from flying debris that could be discharged when employees used the Hunter TCX57 tire changer. This exposed employees to safety hazards.
