29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: On or about June 22, 2021, an employee was observed working on a residential apartment complex roof without utilizing fall protection. This condition exposed the employee to fall hazards greater than 6-feet to the ground below.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill. On or about June 22, 2021 the employer did not ensure that an employee working on a two story apartment complex roof retained the requisite understanding or skill for safe work practice. This condition exposed the employee to fall hazards greater than 6-feet to the ground below.
