29 CFR  1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury:  a) New residential construction, LOT 58, Roof:  On or about 6/23/2021, and at times prior, the employer exposed employees to struck by hazards , in that they are operating a Metabo NR83A3,  3-1/4 strip nail gun at 120 PSI  without eye protection. Safety glasses were not provided to employees while conducting framing activities prior to the beginning of the work day.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) New residential construction, LOT 58, Roof:  On or about 6/23/2021, and at times prior, the employer exposed employees to fall hazards , in that a complete fall protection system was not provided employee who were conducting framing activities on a 8:12 pitched roof at heights measured at 22 feet to the lower level. Employees were conducting framing on the roof.  b) New residential construction, LOT 58, second floor window:  On or about 6/23/2021, and at times prior, the employer exposed employees to fall hazards , in that a complete fall protection system was not provided employee who were conducting framing activities on  the second floor at the window opening at heights measured at 10 feet 2 inches to the lower level. Employees were pulling materials through the open window and standing in the opening on the edge.

29 CFR  1926.1053(b)(13):The top or step of a stepladder was used as a step:  (a) New residential construction, Lot 58, second floor. On or about 6/23/2021, and at times prior, the employer exposed his employee to fall hazards in that the employee was working on the second floor and using  the top cap of a 6 foot A-frame ladder as the last step to gain access from the lower level to the second floor. The height was measured at 10 feet 4 inches from the ground level to the access point of the second floor. Employees engaged in framing work were not provided with a ladder tall enough to gain access to the second floor without having to stand on the top cap. and then pull themselves up to the second floor.

29 CFR  1926.1053(b)(16):Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.  (a) New residential construction, Lot 58, first floor, on or about 6/23/2021, and at times prior, the employer exposed his employee to fall hazards in that the employee was working with a 6 foot A-frame ladder that had the cross brace on one side damaged, one side of the brace was torn from the frame of the ladder. Employees engaged in framing work were not provided with a ladder that was free from defects and taken out of service.
