29 CFR 1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: a) New residential construction, LOT 231, second floor: On or about 6/23/2021, and at times prior, the employer exposed an employee to struck by hazards, in that he was operating a Makita 5007F circular saw to cut framing materials without eye protection. Safety glasses were not provided to the employee prior to conducting framing activities.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a) New residential construction, LOT 231, Second floor: On or about 6/23/2021, and at times prior, the employer exposed employees to fall hazards, in that a complete fall protection system was not provided to employees who were conducting framing activities on the second floor of a new residential construction building. Employees were exposed to unprotected sides and edges at heights measured at 9 feet 8 inches to the lower level.

29 CFR 1926.1053(b)(13):The top or step of a stepladder was used as a step: (a) New residential construction, Lot 231, second floor. On or about 6/23/2021, and at times prior, the employer exposed his employee engaged in framing work to fall hazards of 6 feet in that the employee was working on the second floor and using the top cap of a 6-foot A-frame ladder to gain access from the lower level to the second floor. The height was measured at 9 feet 4 inches from the ground level to the access point of the second floor.
