The competent person on-site failed to ensure a trench inspection was completed prior to allowing employees enter the trench.

29 CFR  1926.651(k)(2):Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.  a) 8 South Montana St, Butte, MT: On or about June 23, 2021 and at times prior, employees were exposed to cave in hazards while transitioning between shoring systems and accessing and egressing the unprotected portion of the 7 foot 6 inch trench. The competent person on-site failed to remove employees from a 7 foot 6 inch vertical wall trench.  b) 8 South Montana St, Butte, MT: On or about June 23, 2021 and at times prior, employees were exposed to struck by hazards while installing fire suppression water line in an improperly shielded 7 foot 6 inch trench. The competent person on-site failed to remove employees from the improperly shielded portion of the trench.

The employer failed to ensure that the protective system that was being used was properly constructed.   b) 8 South Montana Ave, Butte, MT: On or about June 23, 2021, and at times prior, employees were exposed to cave in hazards while transitioning between improperly constructed shielding systems and accessing and egressing the unprotected trench at a depth of 7 feet 6 inches.
