29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to struck by hazards and death from a fallen tree: A private residence located at 22 Banbury Drive, West Simsbury, CT: On or about June 24, 2021, the employer failed to ensure that an employee was positioned at a distance from the tree at least 1.5 times the height of the tree while assisting with felling a 80 foot tall pine tree.

29 CFR 1910.135(a)(1):The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects: On or about 06/24/2021 employees at the Banbury Drive tree removal project were exposed to head injuries. Employees were not provide hardhats to prevent injuries from head impact during tree cutting operations.
