29 CFR 1926.453(b)(2)(v):A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. (a) On or about June 24, 2021, at the construction site located at 7255 S. 76th St. Franklin, WI 53132, an employee was performing tuck-pointing and paint preparations activities on a commercial building while in an aerial lift with no fall protection system in place and was not protected from falling to the lower level. This exposed an employee to a fall hazard of approximately 20 feet.

29 CFR 1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. (a) On or about June 24, 2021, the employer did not ensure an employee exposed to potential fall hazard had been trained to recognize and minimize the fall hazard associated with the work. The CSHO observed no fall protection gear available for use by the employee.
