29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: a) New residential construction, LOT 13, Top plate: On or about 6/24/2021, and at times prior, the employer exposed employees to struck by hazards , in that they are operating a Motabo NV45A5, 3-1/4 strip nail gun at 130 PSI without eye protection. Safety glasses were not provided to employees while conducting framing activities prior to the beginning of the work day.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction, LOT 13, Top Plate: On or about 6/24/2021, and at times prior, the employer exposed employees to fall hazards , in that a complete fall protection system was not provided to employee who were conducting framing activities walking on the top plate at heights measured at 9 feet 2 inches to the lower level. Employees were conducting framing activities from the top plate of the basement area and the fall would have been to the concrete floor below.
