29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction, LOT 113, 114, and 115, Roof: On or about 6/24/2021, and at times prior, the employer exposed employees to fall hazards , in that a complete fall protection system was not provided employee who were conducting framing activities on a flat roof and walking the top plate at heights measured at 11 feet 4 inches to the lower level. Employees were framing activities.

29 CFR 1910.178(l)(1)(ii):The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck a) New residential construction located at lot 113,114 and 115, exterior. On or about 6/24/2021, and at times prior, the employer allowed employees to operate a rough terrain powered industrial forklift truck (Skyjack model SJ1056 TH Ser# 177613) without certification, evaluation, and training on the type of truck they were operating. the operator was engaged in moving framing materials to different areas of the work platform.
