29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  Warehouse Areas: On or about June 23, 2021, and at times prior thereto, employees were exposed to struck-by and ejection hazards, when operating  Unicarriers MCU1F2A25LV forklifts without completing training and evaluation in its operation.

29 CFR  1910.178(n)(4): Industrial truck driver(s) were not required to slow down and sound the horn at cross aisles and wherever vision was obstructed:  a) Warehouse loading docks: On or about June 23, 2021, and at times prior thereto, employees were exposed to a struck-by hazard while not slowing down at cross aisles and/or blind spots during loading and unloading of materials with the forklifts.  b) Warehouse corners: On or about June 23, 2021, and at times prior thereto, employees were exposed to a struck-by hazard while walking to and from the warehouse without being able to see or hear the incoming forklifts.

29 CFR  1910.1200(f)(6)(ii):  Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical:  On or about June 23, 2021, and at times prior thereto,  employees were exposed to a chemical splash hazard, while the employer did not have labels to identify the contents in detail for the 55-gallon drums used for housekeeping diesel.
