29 CFR  1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l):  On or about June 24, 2021, the employer did not certify that each operator of powered industrial trucks, such as a Genie Model GTH-5519, compact telehandler style forklift, had been trained and evaluated to operate the trucks with a certification that included the name of operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about June 24, 2021, during the installation of weatherproof siding material on a one story senior community residential housing development located at ABC Gardens 4868 Fulton Road, Canton, OH 44718, the employer failed to ensure that employees who were performing residential carpentry activities were trained in fall hazard recognition and fall protection systems.  Employees were exposed to a fall from height hazard of approximately 10 feet.  There were no personal fall protection systems or protections in place for employees who were working on the elevated working surface.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   On or about June 24, 2021, during the installation of weatherproof siding material on a one story senior community residential housing development located at ABC Gardens 4868 Fulton Road, Canton, OH 44718, the employer did not ensure employees using an extension ladder extended the ladder 3 feet above the landing area. Employees were exposed to a fall of approximately 9 feet while performing residential carpentry activities.
