29 CFR  1926.451(e)(1):When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.  At this site, employees used the brackets for access and egress onto the scaffold that they worked on for masonry purposes.  This exposed employees to fall hazards.

29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold.   At this worksite, employees engaged in masonry work off a 3 tier scaffold.  The scaffold was incomplete and showed no form of fall protection for the employees working from it.  This exposed employees to fall hazards.

29 CFR  1926.451(g)(4)(i):Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews.  At this worksite, employees worked on an incomplete scaffold with no fall protection in such as guard rails.  This exposed employees to fall hazards.

29 CFR  1926.454(a):The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.   At this worksite, employees who worked on the 3 tier scaffold were not trained as per Mr. Marco Antonio Ibarra, the owner of the company.  This exposed employee to fall hazards.
