29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts: (a) Production - On June 24, 2021, the employer did not ensure that one or more methods of machine guarding was provided to eliminate employee exposure to rotating parts and pinch point hazards while operating the Gates C8-03 Belt Slitting machine. On or about June 19, 2021, an employee suffered a finger amputation while operating The Gates C8-03 belt slitting machine. In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours, either by telephone or in person to the OSHA Area Office that is nearest to the site of incident, by telephone to the OSHA toll-free central telephone number, 1-800-321-OSHA (1-800-321-6742), or by electronic submission using the reporting application located on the OSHA public web site at www.osha.gov: a) The employer did not report a finger amputation that was the result of a work-related incident that occurred on June 19, 2021, to OSHA, within twenty-four (24) hours. The injury was reported to OSHA on June 21, 2021, by another local government agency. No abatement certification or documentation is required for this item.
