29 CFR 1910.28(b)(1)(i)(C):The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by a personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems: JOB SITE: 20 Midwest Drive, Pacific, MO 63069, on or about 6/23/2021, the employer did not ensure that each employee on a walking/working surface with an unprotected side or edge that was 4 feet or more above a lower level is protected from falling by a personal fall protection systems, such as personal fall arrest, travel restraint, or positioning system. The employees were permitted to climb out of the Tri-Arc Man-basket and step onto the racking system, approximately 5 feet and more above ground level without personal fall protection systems, such as personal fall arrest, travel restraint, or positioning system. The workers are exposed to a fall hazard.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: JOB SITE: 20 Midwest Drive, Pacific, MO 63069, on or about 6/23/2021, the employer failed notify employee of modifications and/or additions which may affect the safe operations of the Raymond Electric Forklift, Model: 4250-C30TT, S/N: 425-12-35766, 3000lbs capacity. Forklift operators were permitted to use the Raymond Electric Forklift with a TRI-ARC man basket without the manufacturer's written approval.
