29 CFR  1926.501(b)(5): Each employee on the face of formwork or reinforcing steel was not protected from falling 6 feet (1.8 m) or more to lower levels by personal fall arrest systems, safety net systems, or positioning device systems.  a) Worksite, north side of lot, sewage treatment plant:  On or about June 29, 2021, an employee working 14 feet above the lower floor was installing cast-in place concrete forms for the second floor of a sewage treatment plant and was not provided with guardrail systems, safety net systems, personal fall arrest systems, or any other type of fall protection.  Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.502(b)(2): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structure members were not installed between the top edge of the guardrail system and the walking/working surface when there was no wall or parapet wall at least 21 inches (53 cm) high.   a) Worksite, north side of lot, sewage treatment plant:  On or about June 29, 2021, the employer did not ensure that midrails were installed on the guardrails provided for employee fall protection on the second floor of the sewage treatment plant.  Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
