29 CFR 1910.178(l)(1)(ii):Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). a.) In and around the lumber yard, on or about June 25, 2021, and at times prior to, the employer did not ensure all of their forklift operators successfully completed a powered industrial truck training program before operating forklifts, thus exposing employees to struck-by and crushed-by hazards.

In and around the lumber yard, on or about June 25, 2021, and at times prior to, the employer did not provide refresher training to employees when they were observed operating forklifts in an unsafe manner, to include not wearing the manufacturer installed seatbelt while driving, thus exposing employees to struck-by and crushed-by hazards.
