29 CFR 1910.29(b)(3): 29 CFR 1910.29(b)(3): The employer did not ensure that guardrail systems are capable of withstanding, without failure, a force of at least 200 pounds (890 N) applied in a downward or outward direction within 2 inches (5 cm) of the top edge, at any point along the top rail. On or about June 24, 2021, an employee was exposed to a fall of approximately 23 feet while performing flooring maintenance activities on the balcony of 8690 Broadview Road Apt. E311, Broadview Heights, Ohio 44147. The employee was working on the balcony and the employer did not ensure that the guardrail system was capable of withstanding the required 200 pounds of force.

29 CFR 1910.30(a)(3)(iii): 29 CFR 1910.30(a)(3)(iii): The employer did not train each employee in the correct procedures for installing, inspecting, operating, maintaining, and disassembling the personal fall protection systems that the employee uses: On or about June 24, 2021, an employee was exposed to a fall of approximately 23 feet while performing flooring maintenance activities on the balcony of 8690 Broadview Road Apt. E311, Broadview Heights, Ohio 44147. The employee was working on the balcony and the employer did not ensure that he was trained in the requirements for inspecting and maintaining the guardrail fall protection system.
