OSH ACT of 1970 Section 5(a)(1) : The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a fall hazard:  Parking Lot:  On or about June 25, 2021,  and times prior thereto, employees were exposed to a fall hazard while using a job-made work platform that was attached to a forklift (Skyjack SJ1056TH) to allow employees to work at an elevated height.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d):  29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.   On or about June 25, 2021,  and times prior thereto, employees were exposed to an ejection hazard due the forklift operator was not being trained and evaluated to operate a forklift (Skyjack SJ1056TH).

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about June 25, 2021 and times prior thereto, employees were exposed to a fall hazard while framing a two-level commercial construction building without a fall protection system in place.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about June 25, 2021 and times prior thereto, employees were exposed to fall hazard while framing a two-level commercial construction building using an extension ladder that did not have side rails that extend at least 3 feet above the upper landing.
