29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a. On or about July 1, 2021, at a new building construction job site located near East 14th Street and Superior Avenue, Cleveland, OH, the employer failed to ensure that employees who were performing residential construction activities were protected from a fall from height of approximately 23.5 feet.  There was a partial guardrail system installed along the perimeter prior to erecting perimeter walls.  b.  On or about July 1, 2021, at a new building construction job site located near East 14th Street and Superior Avenue, Cleveland, OH, the employer failed to ensure that employees who were performing residential construction activities were protected from a fall from height of approximately 23.5 feet.  There was no fall protection in place during the erection of perimeter walls.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about July 1, 2021, at a new building construction job site located near East 14th Street and Superior Avenue, Cleveland, OH, the employer failed to ensure that employees who were performing residential carpentry activities and exposed to fall hazards were trained in fall hazard recognition and fall protection systems.  Employees were exposed to a fall from height hazard of approximately 23.5 feet.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about July 1, 2021, employees were exposed to a fall of approximately 20 feet while performing residential carpentry activities on a commercial condominium housing unit located at East 14th Street and Superior Avenue Cleveland, OH  44114. Employees were using an extension ladder to access the upper working surface that did not extend three feet above the landing area.
