29 CFR  1926.20(b)(2): Programs did not provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers:  a) Jobsite:  On June 30, 2021 and at times prior thereto the controlling employer, CM Company, Inc., did not ensure that the dismantling, moving and set up of a walk through type scaffold was done under the supervision and direction of their sub-contractors competent person, before allowing employees to work from the scaffold.   Discrepancies included base plates were not installed on any of the scaffold legs, mud sills were cracked or off center and a safe means of access was not used.    Note) Certification of corrective action is required for this item.

29 CFR  1926.451(c)(2): Supported scaffold poles, legs, posts, frames, and uprights did not bear on base plates and mud sills or other adequate firm foundation:  a) Jobsite:  On June 30, 2021 and at times prior thereto the controlling employer, CM Company, Inc., did not ensure their sub-contractors protected their employees  while performing masonry work from a walk through type scaffold.  Base plates were not in place on any of the scaffold legs, and cracked or off center mud sills were used.    Note) Certification of corrective action is required for this item.

29 CFR  1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface were not used:  a) Jobsite:  On June 30, 2021 and at times prior thereto the controlling employer, CM Company, Inc., did not ensure their sub-contractors protected their employees while performing masonry work from a walk through type scaffold.  A safe means of access to and from the work area on the scaffold was not provided.     Note) Certification of corrective action is required for this item.
