29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact: a) Chickamauga Dam - Between Monoliths: On or about 7/8/2021 and days prior, the employer exposed workers to flash and thermal burns, in that welding PPE including welding shield and /or UV eye protection, arm and body protection, and gloves were not being used by workers conducting welding operations exposing them to flash burn and fire/burn hazards.

29 CFR 1926.351(e): Shielding. Whenever practicable, all arc welding and cutting operations were not shielded by noncombustible or flameproof screens which will protect employees and other persons working in the vicinity from the direct rays of the arc: a) Chickamauga Dam - Between Monoliths: On or about 7/8/2021 and days prior, the employer exposed workers to flash burns, in that shielding was not installed at the location where a welder was installing and welding metal forms in preparation for final installation to protect employees working adjacent to and in direct view of the welding operation.

29 CFR 1926.1425(b): While the operator was not moving the suspended load, no employee shall be within the fall zone, except those employees engaged in; (b)(1): hooking, unhooking, or guiding a load; (b)(2) initial attachment of the load to a component or structure or (b)(3) operating a concrete hopper or bucket: a) Chickamauga Dam - Between Monoliths: On or about 6/29/2021 and days prior, the employer exposed workers to struck-by and crushing hazards, in that employees vibrating and testing the temperature of the concrete were working under the suspended concrete bucket/hopper. b) Chickamauga Dam - Between Monoliths: On or about 8/06/2021 and days prior, the employer exposed workers to struck-by and crushing hazards, in that an employee walked under a suspended form to reach for a tagline.
