29 CFR 1910.178(p)(1):If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition (as referred by 29 CFR 1915.93(a)(3)): a. On or about June 28, 2021, the Taylor 20,000# Forklift 007 was used with cracks in the front windshield exposing the operator and nearby employees to struck by / crushed by hazards. b. On or about June 28, 2021, the Taylor 20,000# Forklift 007 was used with the two rear tires and the two front exterior tires having missing tire material and cracks extending past the tire warning or safety line. The operator and nearby employees are exposed to struck by / crushed by hazards if a load is dropped due to a forklift tire failure. c. On or about June 24, 2021, the Hyster #360 Forklift was used with the right rear tire having a smaller diameter than the new left rear tire. The right rear tire also had a crack that extended past the warning or safety line. The operator and nearby employees are exposed to struck by / crushed by hazards if a load is dropped due to a forklift tire failure. d. On or about June 17, 2021, the Yale #641P Forklift was used with the right front exterior tire having missing material and cracking extending past the warning or safety line. The operator and nearby employees are exposed to struck by / crushed by hazards if a load is dropped due to a forklift tire failure. e. On or about June 24, 2021, the Yale #537P Forklift was used with the left rear tire and right rear tire having missing material and cracking extending past the warning or safety line. The operator and nearby employees are exposed to struck by / crushed by hazards if a load is dropped due to a forklift tire failure. f. On or about July 7, 2021, the Yale #695P Forklift was available for usage with the right rear tire having missing tire material extending past the tire warning or safety line. The operator and nearby employees are exposed to struck by / crushed by hazards if a load is dropped due to a forklift tire failure.
