29 CFR  1910.95(d)(1):When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:  a) An employee performing job duties throughout the facility, such as forklift operation and other duties near equipment, was exposed to continuous noise at 75.3% of the permissible daily exposure limit during monitoring performed for 574 minutes on September 14, 2021.  For the 10 hour extended work shift, the employee was exposed to an equivalent time weighted average of  88.0 dBA, which is 1.06 times the reduced Action Level of 83.4 dBA. The employer did not conduct noise monitoring as required by this section.  b) An employee performing job duties throughout the facility, such as furnace operation and abrasive blasting, was exposed to continuous noise at 55.5% of the permissible daily exposure limit during monitoring performed for 374 minutes on September 14, 2021. For the 10 hour extended work shift, the employee was exposed to an equivalent time weighted average of 85.8 dBA, which is 1.03 times the reduced Action Level of 83.4 dBA. The employer did not conduct noise monitoring as required by this section.    Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR  1910.95(g)(1):The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:  a) An employee performing job duties throughout the facility, such as forklift operation and other duties near equipment, was exposed to continuous noise at 75.3% of the permissible daily exposure limit during monitoring performed for 574 minutes on September 14, 2021.
