29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) On or about July 9, 2021, at the construction site located near W169N8459 Schneider Rd, Menomonee Falls WI 50351, the employer did not ensure that a ladder, ramp or other safe means of egress, for the approximate 18 4/10 foot long trench, was provided for employees working in the trench.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. (a) On or about July 9, 2021, at the construction site located near W169N8459 Schneider Rd, Menomonee Falls WI 50351, employees were exposed to cave-in hazards while conducting a water lateral connection in an unprotected trench. The competent person, the foreman, determined the trench was five foot and required cave-in protection, but failed to have the trench protection installed to protect employees.

(a) On or about July 9, 2021, at the construction site located near W169N8459 Schneider Rd, Menomonee Falls WI 50351, employees were performing work in an approximately six foot deep excavation without adequate cave-in protection, thereby exposing employees to a struck-by / crushing hazard.
