1910.212(a)(3)(ii) The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. On or about July 3, 2021; in the Processing Department, the Marvel Mfg Co CNC bandsaw had unguarded moving parts (e.g. clamps) exposing employees to caught between hazards.

29 CFR 1910.147(c)(6)(ii): The employer shall certify that the periodic inspections have been performed. The certification shall identify the machine or equipment on which the energy control procedure was being utilized, the date of the inspection, the employees included in the inspection, and the person performing the inspection. During the week of June 14, 2021 and thereafter, the employer did not certify the completion of a periodic inspection of the energy control procedures to ensure an accurate procedure and employees were familiar with their responsibilities under the procedures.
